Is there any fire safety requirements in the CDM Regs.... and if all fire safety legislation is being repealed, is the fire bit under the CDM Regs that apply to Fire Safety on building sites also going... if so, why no guidance notes?

Unless I'm misunderstanding, far as I knew the CDM regs don't make recommendations for fire safety, they're all about the safety management of projects metting certain criteria.

The parameters for qualification under the Regulations are for any project which:

·   is expected to last on site for longer than 30 days.
·   is expected to require more than 500 man days; or
·   will require 5 or more persons working on site at any one time.

All design and demolition work and dismantling projects, irrespective of size, are subject to the Regulations.

Rachel,  are you thinking about the Construction (Health Safety and Welfare) Regulations 1996?  If you are they are staying.

Rachel,

You will find no such guidance under CDM.  However all fire safety legislation is applicable, afterall just because it is a construction site does not mean that occupants must be afforded the same basic fire precations

  I did have a LPC guidance document on such undertakings.  If you email me I will forwardit on to you.

I thought the HSE had the lead on this? Particularly as the enforncing authority.

I've done some homework on this lately.

The fire safety bits of the Construction (health safety and welfare) Regs will still be in force. In addition the Fire Safety Order will apply to construction sites.

If it is a self contained construction site then HSE is the enforcing authority for both regs.

If the premises is partially occupied then the Fire and Rescue Authority takes control.
