RRO and former "Special premises" COMAH sites etc

I was asked to carry out a risk assessment at an explosives factory which under previous legislation was covered under the special premises regs and also a COMAH site.
The works consists of a large site with about 40 individual small, lightweight structures, and a nearby office block.

Is the Fire Authority now  responsible for enforcement within the manufacturing area  and does the Fire Safety order apply or have I missed something somewhere? The offices are easy- RRO clearly applies but the works themself?

Have you looked at the Manufacture and storage of explosives regs (MSEAR)

Surely as it's a process, the Helath and Safety Executive will enforce?

As for the RRO, the risk assessment must identify that there are dangerous substances and detail what measures have been taken to ensure the general fire precautions remain adequate.

The key to all this isseperating "special and technical" from general fire precautions. The Order is intended to avoid overlap with HSEs remit by dealing only with general fire precautions. Process risks are not intended to be covered.

Of course trying to decide which is which is a bit harder.

But you can always ask the HSE for some advice!!!!
