Title: Scottish Fire Safety Regs and the English Regs

Are there any main areas in which the two differ?

Are there any areas where the guidance differ?

Is it right common areas of residential are not covered in the Scottish fire safety Laws, is there anywhere where you can compare the two

Excellent stuff.

However is it right that common areas of residential properties do not fall under the remit of the Fire Act in Scotland??

You might need to be careful here with your interpretation of the Scotland legislation which is similar to the NI Order.

In NI the Order, with little exception, applies to all premises but the need for a fire risk assessment in "dwellings" including common areas does not. The Order still requires that measures provided for the protection of Firefighters, to include dwellings, are maintained.

Another thing to consider is the need to study part 3 of Fire (Scotland) Act 2005 and The Fire Safety (Scotland) Regulations 2006 for a full understanding of fire safety legislation in Scotland. There are other regulations as well that need considering. (I think NI is similar)

Hi NT,
        Can you clarify the position in N. Ireland. The Regs exclude dwellings (including common areas) but the NIFRS website for 'FireSafe' under premises affected by the legislation include "Shared areas of properties common to several households"
Confusing or what?

Yep. The legislaton excludes dwellings, which includes common areas, from requiring a FRA but are not excluded from a requirement for the maintenance of measures provided for the protection of Firefighters.
