Can anyone please tell me the difference with regards to the RRO Articles.

They basically mean the same thing. A deficiency or failure of the Order indicates something that doesn't constitute a straight offence. It relates to something of minor or "medium" risk, in other words something that won't put anyone at immediate risk of injury or death.

I have seen an Enforcement Notice recently with both Failure and Deficiency in the same Notice ie

"Failure under Article 8"

"Deficiency from Arcticle 14 (2) (b)"

Not many things in Article 8 so that is easily a failure to comply.  Many things in Article 14 and therefore deficient in an area.  Simples or not!
