Does anyone have a view on the following.


Multi Storey converted block of flats with commercial use of ground floor. Building in one ownership except for one shop on ground floor which has a flying freehold. Fire alarm elsewhere but not in this shop and owner will not allow alarm to be extended into the shop.. What can owner of building do? Is there any legal fall back to ensure owner of shop complies to ensure safety of rest of occupants

Depends... Firstly we need to establish the level of separation between the shops / flats - if 60 minutes fire resisting seperation is present then an interlinked fire alarm wouldn't be required (building regs).

If you are unsure about the level of separation, or feel that the integrity of the seperation is compromised then the owner of the shop is IMHO duty bound under the RRFSO 2005 to install an interlinked system

Articles under which this issue would be dealt with :-

1) Article 8(1)(b) - safety of relevant persons whom are not his employees

2) Article 13(1)(a)(b) and (2) to the extent that is apporpriate fire detection having regard to the dimensions and use of the premises.

3) Article 22(1)(a)(b) and (c) - co-op and co-ordination with other responsible persons

Thanks for that. I havent seen building yet just a query from a client. Howver from what I know of building it is an old warehouse converted, probably prior to 91, and is also listed, so probably not 60 minute.

The separation is the key.  If it is not to a 60 min standard then a suitable FA should be installed t protect the relevant persons.
