All my responses only apply to England and Wales and they are an overview of the subject, hopefully it will point you in the right direction and always treat with caution.

About time to!! I wonder if he would have been prosecuted if he hadn't meddled with and bodged the FFE maintenance? After all, F&RS across the country find unsuitable FRAs daily, and few assessors are ever prosecuted for such an offence.

I have just noticed that his website has been taken down - but he is all over Linkin so easy to find. Surely this sort of reputational damage for a SME is almost irrecoverable?

Just one pedantic point of order (excuse the pun). Its rather sad that Devon & Somerset's press release mentions the guy was prosecuted under 'Sections 9 and 17 of the Regulatory Reform (Fire Safety) Order 2005', apparently not recognising the Order has 'Articles' and not 'Sections'. Just as well their FS Dept is more competent than their Press Office

I would have thought he committed an offence under article 32(10) which resulted in him being charged with an offence under article 9 and 17?

I'm surprised he actually got caught for 'ragging & tagging' the extinguishers - happens up & down the country every day and I think if he had stuck to that & not dabbled in FRAs he would have got away with it - it's almost a carbon copy of the Notts prosecution where another rag & tag extinguisher guy got his fingers burnt dabbling in FRAs

Hmm all velly intelesting.  From the company website, once gleans information that:

Mr Stonelake was in the fire and rescue service, where he gained a vast amount of experience in the fire protection area and developed excellent skills in fire risk inspection and fire safety audits (as one surely would in the fire and rescue service).

He had the NEBOSH certificate in fire safety and risk management.

All the company's extinguisher technicians were BAFE registered, having completed the IFEDA course. I dont think it right, Davey to allege that the gentleman "meddled and bodged".

The company offered PAT testing, fire safety signs, training, etc.

Main thing done wrong (as it appears to me) is that there was a bit in the company website that said "who it applys to".  I always think it is a crime to end a sentence or a clause with a preposition, while the word should be "applies".  Clearly, Davey, the author of the website was not in your dearly departed FRS, the grammatical standards of which are, of course, exemplary, save that many of them think that the past simple of the verb to do is "done".

Well all that proves is that you can hold all the certificates you want but you can still do a poor enough job to be prosecuted & convicted....
