Unoccupied upper floors?

The question is in relation to a two storey building of traditional style - forming part of a terrace in a town - there will be a pub at ground floor.  
The owner does not want to use first floor at all and intends to remove any stairs and slab over the ground floor ceiling so that there will be no access to the first floor.  I am intending to tell him that access will be required - after all there will need to be smoke detectors up there, and they will need to be maintained.  Is there any fire safety legislation in relation to vacant/un-used premises of this type?

If you suitably shut down the first floor by removing all combustibles and and ignition sources I would suggest that no detection would be required in the first floor so long as the area is slabbed off and suitable fire resistance is achieved.

If, as Big T says, you remove all ignition and fuel sources you can always assess the area anyway and record the risk as insignifigant and tolerable.
