Is a protected route required?

Hi all, wonder if you could help.

A 3 storey residential property is split into two blocks, one containing 4 units and the other 9 units. In the larger block, with 3 units per floor, there is a protected staircase. In the smaller block, there are 2 flats on the 1st and 2nd storey only but no staircase protection is provided; the ground floor is purely for access. The property was built in 1995 as far as i can find. Any ideas why this might be, is a protected stair not required if only 2 units per floor and if so, where can i find information on this?

You need to quote the 2001 version, I believe the content is the same but IIR the numbers might be different.
