"These Regulations, which apply to England only, provide that employers must take into account employees’ capabilities as regards fire safety in entrusting tasks to them."

To me it is the equivalent of the bit in the guidance to the First Aid regulations that says you can't just make someone a first aider, but must select them based on their physical & mental capacity to deal with incidents and render correct treatment effectively. 

Hence for example you must ensure that prospective fire wardens are actually fit for role, especially if they are helping implementing PEEPs via Evac chairs. Also they shouldn't be of a nervous disposition so they can remain calm and focussed and able to give instructions under the stress of a fire incident.

My first thought was Lakenal House but  I note from the guidance that it is down to an oversight in the Fire Safety Order where article 47 disapplied the H&S Management Regs without replicating this requirement from the European  directive.

People now blame everything from global warming  to the the price of fruit and veg on Lakanal House. But this oversight was announced some time ago, so, no, Kurnal, you are right its nothing to do with it. It is apparently just what you said, an oversight on the part of the overpaid civil servants at a certain Goverment Department (in England and Wales), who want to tell everyone else how to do their jobs but apparently cannot competently master their own.
No wonder they want to strike about redundancy payments, as, come the revolution (or a General Election) that is what some of them will be facing. At least they have that much foresight.
But Wee Brian will be ok cos they will still need someone with brains to do their thinking for them.

It is interesting that the SI does not go on to mirror Reg 13 (2), the requirement to provide adequate training and Reg 13 (3), to repeat and adapt the training and carry it out in work hours.

Perhaps our lords and masters have not read that far yet?
