It seems that we have laboured under a misapprehension with regard to RR(FS)O, in that the prime enforcer should be the FRS.  Whilst others have a responsibility to enforce, it was FRS responsibility.  It now seems that Local Authorities, who have a responsibility to enforce RR(FS)O when the safety certificate is in force, will have that extended to all times.  Therefore, when some football stadia have all their shops, offices and other paraphanalia under the safety certificate, the FRS have no responsibility.  An examaple is that one of the London stadia has a hotel which is used as a hotel a lot but on match days becomes a viewing platform.  If there is now a fire, the LA is responsible.  I can imagine the LA attendance at 2 am to deal with the impact.  any thoughts or clarification.  It is a change from that expected and from that under the FPWL.

Is this a local arrangement / understanding or is it new information ?  If the latter, I'd be interested to know the source.

The Local Authority is the enforcing authority for the RR(FS)O in Licensed sports stadia.

I don't see what getting there at 2am has got to do with it. Anway you have got plenty to do already.

Wee Brian,  You are correct of course but the original interpretation was that they would only have enforcing powers when the safety certificate was in force, at whatever times they were for the event.  Any other event, for instance a concert at a football stadium, the enforcing authority would be the FRS.  Outside of those times the certificate is in force it would be the FRS.  As regards me, I have a foot in both camps, the original fence sitter.

I see the point, the Order is quite clear that it applies to the premises rather than the activity.This makes sense to me. Why have different authorities depending on what day of the week it is. Both are equally competent to do the job.

The fire authority is a member of the licensing panel (cant remember what that is called) so the brigade can still stick its oar in.

...or the Local Authority can appoint the Fire Authority to carry out its enforcement duties!

Local Authorities suggested at consultation stage that they should enforce everything in stadia, etc. Government happy to oblige.
